Health Guarantee Addendum
1. Health Guarantee Overview
The breeder guarantees that the puppy is in good health at the time of sale and has been selectively bred from a lineage known for its genetic soundness. This guarantee is provided under the following terms and conditions.
2. Genetic Health Guarantee
The breeder guarantees that the puppy is free from any known genetic disorders that are common to the breed. This guarantee is valid for a period of 6 months from the date of purchase. The breeder has conducted health screenings and genetic testing on the breeding dogs to ensure the absence of hereditary conditions.
3. Veterinary Checkup Requirement
The buyer agrees to have the puppy examined by a licensed veterinarian within 10 days of the purchase date. If the veterinarian identifies any serious health issues that are deemed to be genetic in nature, the buyer must provide written documentation from the veterinarian to the breeder within this time frame.
DHPP/DAPP series — first dose given on 6-7 weeks age. Buyer agrees to continue boosters every 3–4 weeks until the puppy reaches 16 weeks of age.
Rabies — recommended at 12–16 weeks (not given prior to transfer unless documented). Buyer agrees to obtain rabies vaccination in accordance with Colorado law. Seller will provide copies of veterinary records documenting vaccines and deworming when needed to Buyer at transfer.
Buyer agrees that the puppy will be spayed/neutered between 18 and 24 months of age. Proof (veterinary invoice/record) must be provided to Seller within 14 days of the procedure.
4. Limitations of the Guarantee
This health guarantee does not cover:
Any health issues that arise after the 10-day veterinary checkup period.
Conditions resulting from neglect, improper care, or accidents.
Any health issues that are not genetically related.
Any vaccinations or treatments that are not administered by a licensed veterinarian.
5. Remedies
If a genetic health issue is confirmed by a licensed veterinarian within the guarantee period, the breeder will offer one of the following remedies at their discretion:
Replacement of the puppy with another of equal value, if available.
A refund of the purchase price, excluding any deposits or fees.
6. Buyer Responsibilities
Provide appropriate veterinary care, vaccinations, parasite prevention, nutrition, and safe housing.
Notify Seller of any serious illness or death of the puppy within 48 hours. Return Policy If Buyer cannot keep the puppy for any reason, Buyer must notify Seller and make reasonable attempts to return the puppy to Seller. Seller retains first right of refusal.
Buyer agrees to have the animal spayed or neutered between 18 and 24 months of age and to provide Seller with written proof (veterinary invoice or certificate) within 14 days after the procedure. If Buyer fails to provide proof of spay/neuter within the required timeframe, Buyer shall pay liquidated damages equal to $3,500 as a reasonable pre‑estimate of Seller’s damages. Buyer’s payment of liquidated damages shall not preclude Seller from exercising other contract remedies, including repossession of the animal.
Limitation of Liability Except as expressly provided, Seller’s liability is limited to refund of the purchase price. Seller is not liable for veterinary expenses incurred after transfer unless agreed in writing.
7. Acknowledgment
By signing this health guarantee, the buyer acknowledges that they have read, understood, and agreed to the terms outlined herein. The buyer also acknowledges that the breeder has taken all reasonable steps to ensure the health and genetic soundness of the puppy.
8. Registration & Papers
Seller will provide AKC (or applicable) registration information and copies of parents’ JKC pedigrees at transfer. If Buyer elects separate registration with another kennel club (e.g., Japan Kennel Club), Buyer is responsible for $700 fees.
9. Limitation of Liability
Except as expressly provided, Seller’s liability is limited to refund of the purchase price. Seller is not liable for veterinary expenses incurred after transfer unless agreed in writing.
10. Governing Law & Venue
This Agreement is governed by the laws of the State of Colorado. Any dispute shall be resolved in the state or federal courts located in Jefferson, Colorado.
